QAt Section 8 sites, what are the HUD guidelines for income generated by mobile communications devices, such as cell phone towers, that are mounted on site buildings?
QI was reading through the item in your April 2009 issue, “Top 10 Audit Findings in 2008” (p. 1). I noticed that #10 on the list was “Rejection letter lacks new reasonable accommodation language.” Where can I find this new language?
QA resident of my site recently passed away. I believe the late resident's son will try to continue to stay in the unit, but we do not want him to. How do we request that he move out? How are these situations typically handled?
QShould a lump-sum severance payment be counted as an asset? A resident received a one-time payment of $30,000 at the end of employment. Is it income or an asset? Will the $30,000 be counted as income for the next year?
QI have a potential applicant at my Section 202/8 site who is being informally represented by her sister. The helper-sister routinely handles most of the applicant's affairs and wants to sign application materials on her behalf. She would like to receive a copy of the notice when her sister is called from the waiting list. The helper-sister is afraid the applicant-sister will not understand the notice letter and miss her chance at admission. Am I allowed to send a notice to the applicant's sister?
QIf a resident gives a 30-day notice to move out at the end of the month, but does not actually move out until the middle of the following month, is the owner entitled to that month's housing assistance payment (HAP)? The resident's new unit was inspected and approved, and the new owner was issued the HAP on the first of the month, but the resident did not move in until the middle of the month.
QA unit at the site I manage has roaches, but the resident will not allow the exterminator to come into the unit. The resident says that she has respiratory problems; she claims that it would be too much of a hardship for her to leave for any length of time, and she does not want anyone in her unit when she is not there. She also doesn't want to breathe the chemicals the exterminator would use. What should I do?
QI know a mutual fund is an asset, but should I treat it the way I treat a current savings account or the way I treat a checking account, using a six-month average balance?
QCan resident councils in multifamily complexes vote out current officers?
AAccording to Bramlet, the LIHTC program offers no guidance on this type of issue. HUD also does not have rules on resident councils in multifamily properties, though it does in public housing. This is a management issue and a legal issue, so refer to the governing documents establishing the resident councils to see what needs to happen to displace their current officers.
